1. Eligibility

The Service is intended for use by individuals who are at least eighteen (18) years of age. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

 

2. Account Registration and Security

To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you believe your account has been compromised or used without authorization.

We are not responsible for any loss or damage resulting from unauthorized access to your account due to your failure to safeguard your credentials.

 

3. User Content

(a) Ownership

You retain ownership of all content you submit, upload, or otherwise make available through the Service, including photos, videos, text, memories, child-related information, and other materials (“User Content”).

(b) License to Baby Resume

By submitting User Content, you grant Baby Resume a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, modify, and distribute your User Content solely for the purpose of operating, improving, and providing the Service, including enabling sharing features you choose to use.

This license terminates when you delete your User Content or your account, except to the extent we are required to retain certain information for legal, security, or operational purposes.

(c) Responsibility for Content

You are solely responsible for your User Content and for any consequences of sharing it through the Service. You represent and warrant that you have all rights necessary to submit the User Content and that such content does not violate any laws or the rights of any third party.

 

4. Sharing and Invited Users

The Service may allow you to invite family members, friends, caregivers, or other individuals to view or interact with your User Content. You control whom you invite and what content is shared.

Once you grant access to another user, that user may view, download, screenshot, or otherwise retain shared content depending on their device and settings. Baby Resume does not control and is not responsible for how invited users use or further share User Content after access has been granted.

You acknowledge and accept the risks associated with sharing User Content with others.

 

5. Prohibited Conduct

You agree not to use the Service to:

• Violate any applicable law or regulation

• Infringe the rights of others, including privacy, intellectual property, or publicity rights

• Upload content that is unlawful, harmful, abusive, defamatory, obscene, or otherwise objectionable

• Attempt to gain unauthorized access to the Service or other users’ accounts

• Interfere with or disrupt the integrity or performance of the Service

• Use the Service for commercial purposes without our prior written consent

We reserve the right to investigate and take appropriate action against violations of these Terms, including suspending or terminating accounts.

 

6. Reasonable and Intended Use of Storage and Data

The Service is for the reasonable and intended usage of the Baby Resume application: to collect, organize and share information - within the score of the application with family and friends. We reserve the right to limit storage and use of data where you use the Baby Resume as a means for more general storage and use of data.\

7. Subscriptions and Payments

Certain features of the Service may be offered through paid subscriptions.

All payments are processed through third-party payment providers (such as Apple or Google). We do not store full payment card information. Subscription pricing, billing cycles, and renewal terms will be disclosed at the time of purchase.

Subscriptions may automatically renew unless canceled through your account settings or the applicable app store prior to the renewal date. Refunds are subject to the policies of the platform through which the purchase was made.

We reserve the right to modify pricing or subscription offerings at any time, subject to applicable law.

 

8. Intellectual Property

The Service, including its design, layout, features, trademarks, logos, and underlying software, is owned by Baby Resume or its licensors and is protected by intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, or create derivative works based on the Service without our prior written consent.

 

9. Third-Party Services and Links

The Service may contain links to third-party websites or services. We do not control and are not responsible for the content, policies, or practices of third parties. Your use of third-party services is at your own risk and subject to their terms and policies.

 

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, BABY RESUME DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT WILL BE ACCURATE OR RELIABLE.

 

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BABY RESUME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL BABY RESUME’S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO BABY RESUME FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (US $100), WHICHEVER IS GREATER.

 

12. Indemnification

You agree to indemnify, defend, and hold harmless Baby Resume and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

 

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if required by law.

You may terminate your account at any time through the Service or by contacting us. Certain provisions of these Terms will survive termination, including intellectual property, disclaimers, limitations of liability, and indemnification.

 

14. Modifications to the Service or Terms

We reserve the right to modify or discontinue the Service, or to update these Terms, at any time. If we make material changes, we will provide notice as required by law. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

 

15. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Florida, unless otherwise required by applicable law.

 

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
